Booking Terms & Conditions for My Ibiza

My Ibiza Booking Terms and Conditions are subject to change without notice.
These website terms and conditions constitute the sole record of the agreement between you and The Property Management Company in relation to your use of the website. Neither you nor The Property Management Company shall be bound by any express tacit or implied representation, warranty, promise or the like not recorded herein. Unless otherwise specifically stated these website terms and conditions supersede and replace all prior commitments, undertakings or representations, whether written or oral, between you and The Property Management Company in respect of your use of the website. The Property Management Company may at any time modify any relevant terms and conditions, policies or notices. You acknowledge that by visiting the website from time to time, you shall become bound to the current version of the relevant terms and conditions (the “current version”) and, unless stated in the current version, all previous versions shall be superseded by the current version. You shall be responsible for reviewing the then current version each time you visit the website.

1)     General
The contract is between you the person who is renting the Villa and The Property Management Company  (My Ibiza).

2)     Formation of the contract
Before making a booking, please contact The Property Management Company  to make sure the Villa is available for the dates required. You must send The Property Management Company  a completed booking form and payment of a non-refundable deposit of 30% of the property rental. A binding contract between the person who has signed the Booking Form and the Property Management Company  will be made when The Property Management Company  issue a confirmation invoice. You are responsible for the payment of the price of the full rental and the compliance of the members of your party with these conditions.
Bookings cannot be accepted from persons under 18 years of age at the time of booking. The Property Management Company  reserve the right to refuse a booking without giving a reason.

3)     Payment
The balance must be paid no later than 10 weeks before departure. Failure to pay the balance on time will constitute cancellation and cancellation charges will become payable in accordance with the paragraph 6. and paragraph 7 below.
If you book less than 10 weeks before departure the full balance of the rental is payable at the time of booking.
Receipt and banking of any deposit does not constitute acceptance of any booking. A binding contract is made when The Property Management Company  issue a confirmation notice.
Payment using a credit card carries a 3% charge, payment using a debit card has no charge.

4) The Price
The prices are in sterling and the rental period is weekly, unless otherwise stated.  The price does NOT include any locally levied taxes such as Tourist Tax or ECO tax that can be imposed at any point by the Ibizan authorities. This tax can range in price, per person per night and is collected on island either at the airport or by the Villa Management Company.
The Property is let furnished and equipped. The price includes linen, and final cleaning services. The price does not include charges for the use of air-conditioning units in the property, either fixed or portable. If air-conditioning is available in the property, there is a charge of €20 per day for its use. This can be paid with the balance of your holiday, or locally on arrival.

5)     Accidental Damage Waiver
We have replaced the traditional large Security Deposit payment with an Accidental Damage Waiver that is added to the cost of your villa rental and paid with your balance.
For a non-refundable charge of £11.95 or the euro equivalent per person payable with your balance, clients will be covered for any accidental damages that occur during their stay in the villa.
The ADW charge will cover you for any non-intentional breakages or damage to the Villa or its contents, up to the value of £1500 or the equivalent in euros per group. Any accidental damage or breakages must be reported while clients are in occupancy of the Villa.
IMPORTANT: The ADW will not cover clients for wilful, deliberate or malicious damages to the Villa or its contents, or for damages or breakages that are not reported during the clients’ occupancy of the Villa. It does not cover damage to the pool, or the cost of draining and refilling the pool due to broken glass or other items being found in the pool.
The ADW does not cover fines from the police or other Island Authorities incurred for any type of anti-social behaviour, illegal activity or complaints arising from noise or disturbance.
The ADW does not cover extra cleaning or rubbish removal costs if the Villa is deliberately left in an excessively dirty state.
Any charges the company needs to make due to any of the above circumstances not covered by the ADW, will be invoiced to the Lead Client after departure.

6)     Alterations or Cancellations
In the unlikely event it is necessary to make an alteration or cancel your villa rental, we will inform you as soon as possible and we will try and arrange alternative accommodation for a villa of a similar type and standard, and in a similar location. Any price difference will be refunded. In the event we cannot find you suitable accommodation monies will be refunded.

7)     Cancellation by You
Any cancellation by you for whatever reason must be emailed to Jason@myibiza.co.uk
The effective date of cancellation is the date on which we receive written cancellation.
If you cancel 10 weeks or more before departure you will lose your deposit.
If you cancel within 10 weeks of departure or if the holiday booking is cancelled due to non-payment we are entitled to full holiday cost from you.

8)     Amendments by you
Upon receipt of your booking confirmation invoice, please check the details to make sure they are correct. If after your booking has been accepted you require us to amend it in any way or re-invoice you, we reserve the right to charge £30 per change.

9)   Villa Representation
While all the photographs you see and descriptions you read are fundamentally correct, we cannot accept responsibility if minor errors or differences in the photographs / illustrations / text used and the actual property arise.
The Property Management Company  reserve the right to make modifications to the property specification that are considered necessary in the light of operating requirements. In the interest of continued improvements, The Property Management Company  reserve the right to alter furniture, fittings, amenities, facilities, or any activities, either advertised or previously available, without prior notice.
If material changes occur after your booking has been made we will advise you if there is time before your departure.

10)   Number of People using the Villa
Only those persons named on the booking form may use the property without prior arrangement. The number of people staying at the property must not exceed the number of sleeping places indicated in the advertised material, except in the case of infants under two years of ages or written consent from The Property Management Company .  The Property Owner and the manager reserves the right to revoke the booking at their sole discretion. This means should we discover more people in the villa than appears on the booking form we have the right to cancel the booking and evict the group immediately or apply a surcharge payable immediately.

11)   Access
The Property Management Company or his/her representative shall be allowed free access to the Villa, owned by The Property Management Company  sat any reasonable time during any holiday occupancy for the purposes of inspection and maintenance.

12)   Arrival and Departure
You must arrive after 16:00 on the holiday start date, and the accommodation must be vacated by 10:00 on the last day unless otherwise specified by the Property Management Company  in writing. If these times are difficult please advise when you are booking. If your arrival is delayed please inform the Property Management Company  so that suitable arrangements can be made for entry to the Villa.

13)   Pets
Pets are not allowed without prior written permission of the Property Owner. You may be asked to pay a security deposit.

14)   Your Responsibilities
You must keep the Villa (holiday accommodation) and all furniture, fittings effects, facilities and equipment in the same state of repair and condition as at the commencement of your holiday or stay. You must leave the Villa (the holiday accommodation) in the same state of cleanliness and general order in which you found it. You are responsible for all damage or loss which occurs to the property or its contents during your occupation and will be responsible for paying appropriate compensation to The Property Management Company  in the event of breakages or damage. You must not allow any illegal activities or illegal substances in the premises. You must recognize local noise restrictions, for instance no music outside after 11pm and before 8am. Clients may not bring their own, or externally hired, professional music equipment or amplification devices; these are strictly prohibited. Failure to comply will render the contract null and void and can lead to eviction from the villa, with no reimbursement of monies paid. Clients are also responsible for any local fines for noise or illegal activities. It is worth noting the fine for noise is between 600 euros and 12000 euros. The normal fine is 6000 euros.

15)   Complaints
In the unlikely event that you are disappointed with the Villa, you must contact the Property Management Company  or local representative during your occupancy who will try to solve the problem. If after that you feel that the problems were not sorted out to your satisfaction please write to the Property Management Company within seven days of returning from your holiday at the Villa. If you vacate the property before the end of your rental period without our authorisation you shall lose any rights to compensation. We cannot accept responsibility for any retrospective complaints that have not been reported to us and documented during your occupancy.

16)   Liability of us, The Property Management Company
We shall not be responsible for the death of, or personal injury of, you or any person named on the booking form or other person at the property unless this results from the proven negligence of the Property Management Company .
Any accidents which occur whilst you are drunk or under the influence of drugs are not the responsibility of the Property Management company or the owners. We shall not be responsible for any loss, breach or delay beyond our reasonable control, including though, but not limited to, act of God, explosion, flood, tempest, fire or accident, war or threat of war, civil disturbance, acts, restrictions, regulations, by-laws, or measures of any kind on the part of governmental or local authority, strikes. Lockouts, or other industrial actions or disputes or adverse weather conditions. In any such case we shall be entitled to treat the contract as discharged.
In the event of such a discharge our liability shall be limited to the return of the sums paid to us in respect of the unused portion of the rental calculated on a pro-rata daily basis less an administrative charge of £20.00 to cover our reasonable expenses.
We cannot be held responsible for the breakdown of mechanical equipment, such as pumps, boilers, swimming pool filtration systems etc, nor for failure of public utilities such as water, electricity, wifi and TV signals and gas, or for any water wells or cisterns feeding the Villa.
We are not responsible for noise and disturbance originating beyond the boundaries of the Villa or anything which is beyond our control.

17)   Cleaning
The property will be cleaned throughout at the beginning of the rental period and you must leave it clean throughout and at the end of the rental period. The Property Management Company will invoice the lead client for any extra costs related to cleaning and repairing the villa.

18)   Behaviour
The person signing the contract is responsible for the correct and decent behaviour of his / her party. Should you and your party not behave in a decent and suitable manner the Owner, key holder, Property Management Company  or Local Representative at his / her absolute discretion can ask you and your party to vacate the property without any refund in the price.

19)   Staff
Cleaning staff is included as outlined in paragraph 17. Additional staff could be provided for an extra cost. Please give us as much notice as possible, but we cannot always guarantee availability. We accept no responsibility for additional staff or services. Any other arrangements you make between your staff or any other person or company providing services when you are at the Villa, are between you and your staff and we accept no responsibility for these services service provided and the terms on which they are provided.
20)   Linen
Linen is included in the Villa , but it is advisable to take your own beach towels and cot linen. Linen is normally changed once per week. If you require more frequent changes there will be an extra charge.

21)   Swimming Pools
The Swimming Pool will usually be closed in the winter months (November to March) If the rental falls within this period please check with us if the pool is open.

22)   Photographs
Photographs taken at the Villa cannot be sold for profit without the permission of The Property Management Company .

23)   Social Events
It is the policy of the Property Management Company not to allow social events and other functions (e.g. weddings, receptions or Blessing Ceremonies, large outdoor barbecue events etc) on the property without prior agreement with us, the Property Management Company.

24)   Security and Valuables
Any valuables left at the property are at your own risk. The Property Management Company, local representative or agents are not responsible for your loss. As with all rental property in prime locations, there is a risk of burglary. The burglar alarms and any security must be activated. It is your responsibility to advise the Property Management Company  immediately on arrival if any of the security systems or safety deposit boxes do not work. The property owner will take all reasonable steps to correct any fault but we cannot guarantee to fix the fault during your rental. We accept no responsibility for any loss, damage or consequential losses due to theft or any security related incident however caused. The safety deposit boxes are for the storage of cash, cards, passports etc. In most cases they are not large enough to store multiple mobile phones or other electrical devices. We strongly advise that clients do not bring such items with them, and we cannot be held responsible for their loss or damage should you choose to bring such items with you.
25)   Insurance
It is a condition of booking that all members of your group are covered by a valid  Comprehensive Travel Insurance policy. Please ensure you have arranged sufficient cover for any medical or injury costs and for all your personal belongings.

26)   Problems and Faults
Please note: Any problems and faults in the villa, even matters concerning light bulb failure, should be reported to the local representative within a reasonable period of time, for instance 24 hours. We cannot accept retrospective complaints that have not been reported or documented during your occupancy of the villa.
27)   Rubbish disposal
It is your responsibility to remove daily rubbish from the premises. Failure to do so will result in the rubbish being removed by the local representative and there may be a charge incurred for this service.

28)   Contract
All contractual obligations arising out of these booking conditions shall be deemed to come into existence in Shoreham by Sea, West Sussex and be subject to British Law and the exclusive jurisdiction of the British Courts.

29)   Law
My Ibiza (The Property Management Company) will rent the customer / client the property for an agreed period. All other services associated with the rental are not included in the price of the rental. Any services must be paid directly to the supplier.

30)   Privacy Policy
We do not store personal and financial information in the process of payment, nor do we share this information with 3rd parties.
